Bankruptcy Help

In three decades of experience we have helped thousands of individuals and families obtain a fresh start and financial health under all chapters of the federal bankruptcy laws.

Chapter 7 is the most common bankruptcy for individuals.  You will receive a discharge that provides a “fresh start” from most debts. Most people are allowed to exempt and retain their home, cars and personal property.

Chapter 13 is a payment plan for individuals with regular income to pay some or all their debts over time. Chapter 13 is a debt consolidation in which you make payments to a trustee, who in turn distributes your payments to your creditors according to the terms of a court-approved plan.

Chapter 13 allows you to keep valuable property which might otherwise be lost to foreclosure or repossession and permits some debts – such as automobile loans and mortgages – to be adjusted to fit your budget.

Chapter 11 is a reorganization by businesses and individuals with significant assets or debts. You maintain control of the day-to-day operations of the business or your assets and work to develop and gain court approval of a plan to restructure and pay your debts.

Bankruptcy is a complicated area of the law and these descriptions are intended as only a general overview. Whether you are eligible or suited for any bankruptcy option depends on your specific circumstances. Our experience will help you determine the best course for you.
